TERMS OF SERVICE

Thank you for choosing Aqua Vista Pro Pool Service LLC as your swimming pool maintenance provider! This contract outlines the services you will receive, the payments you will be responsible for, and the terms of service that you and Aqua Vista Pro Pool Service LLC will be governed by so long as this contract is in place. This contract acknowledges the standard & duty of care by which Aqua Vista Pro Pool Service LLC will abide, doing so through the terms outlined in this contract, accurate record-keeping, and providing the needed training for our technicians, including but not limited to CPO certification.


Maintenance Packages

We offer a variety of service packages:


Chemical Service - Typically 5-10 min weekly

• Weekly water analysis & adjustment

• Preventative visual pool equipment inspection

• Emptying skimmer baskets, trap baskets, and pool sweep bags

• Weekly service reports


Chemical Brush - Typically 10-15 min weekly

• Weekly water analysis & adjustment

• Preventative visual pool equipment inspection

• Emptying skimmer baskets, trap baskets, and pool sweep bags

• Brushing sides & steps

• Weekly service reports


Full Service - Typically 15-30 min weekly

• Weekly water analysis & adjustment

• Preventative visual pool equipment inspection

• Emptying skimmer baskets, trap baskets, and pool sweep bags

• Full Brush

• Full debris removal via skimming or vacuuming (whichever is needed)

• Weekly service reports 


Service Schedule

We aim to perform maintenance on the same day of the week at each interval to ensure consistency, but alternate service days may be necessary based on availability. We will notify you via phone and email at least one day before each re-scheduled swimming pool maintenance service. You or Aqua Vista Pro Pool Service LLC may cancel service anytime. Any outstanding payments must be made before or immediately after canceling the service.


Recurring Services

Filter cleanings are performed and billed every six months. Salt cell cleanings are performed and billed every three months. We backwash D.E. and Sand filters as needed free of charge (however, backwashing the filter is not the same as filter cleaning. We still perform a filter cleaning on D.E. filters every six months). Please notify us if you prefer to perform filter and salt cell cleanings yourself. Water conditioners (including but not limited to CYA, Enzymes, Phosphate removers, Boric Acid, and PoolRX) are added and billed for every Spring season or as needed.


Holidays

We will provide a Chemical Basket Service if your regularly scheduled maintenance date falls on a holiday. We do not provide service on Thanksgiving & Christmas weeks. Each technician has two additional weeks to use as “floating holidays” or “sick leave.” These occurrences do not affect monthly billing. We will add extra chemicals at no cost to you on weeks before & after scheduled leave to prevent the pool from growing algae. If the pool happens to grow algae or fill with debris on such occurrences, we will perform what is otherwise known as a service, “Beyond Normal Maintenance,” at no extra charge to you. 


Weather Advisories

We are at the mercy of the weather. Sometimes, extreme weather conditions prevent us from providing full service to customers. We can only offer a Chemical Service if a weather advisory (including air quality advisories) is issued. Please note: We may decide to cancel service in cases of extreme weather (including but not limited to: Heavy rains, winds, lightning, fires, etc.) that cause unsafe work conditions. In the chance of heavy rain, you are responsible for draining water from the pool to prevent flooding.


Access

Your responsibility is to ensure that our technician has full access to your pool and that the pool equipment is running according to its schedule. We cannot provide service for weeks should our technician arrive and not have access to the yard due to locked gates, blocked paths, and aggressive pets.


Services Beyond Normal Maintenance & Chemicals

Should your pool require cleaning or maintenance beyond routine maintenance, we will bill your account at a flat rate of $35. “Beyond Normal Maintenance” is defined as extra cleanup, including but not limited to skimming, vacuuming, clearing clogs, etc., of pool debris due to storms, landscaping services, parties, user error, missed service due to access or another issue, etc. “Beyond Normal Maintenance” begins after 30 minutes have been spent servicing the pool. If you have landscapers, please talk to them about blowing leaves away from the pool deck.

Regarding chemical usage, all maintenance packages include chemicals (unless otherwise quoted) up to 4 gallons of chlorine, four chlorine tablets, and 2 gallons of muriatic acid a month. Chemical usage beyond this (extra chemicals added due to leaks, chlorine blocks, green-to-clean, or extreme weather) is billed separately per extra gallon. Specialty chemicals are billed for as needed.


Equipment Repairs

Repairs are not included in the maintenance packages. Minor equipment repairs under $65 are considered “preventative maintenance” and “pre-approved.” These repairs will be done on an as-need basis. This guarantees the pool will stay in good working order and prevents minor problems from growing (possibly costing you more money). 

Any equipment repairs over $65 will be reported to you for approval. All equipment repairs are billed on the next month's invoice. Some homeowners prefer to perform equipment repairs themselves. If this is your wish, you agree to take full responsibility for performing repairs as needed; the burden of reporting needed equipment repairs falls on Aqua Vista Pro Pool Service LLC. Significant repairs (filter & pump installations, green-to-cleans, etc.) require payment on the day of. Should the pool require extra cleaning beyond routine maintenance due to failure to approve significant repairs to pool equipment (filters, pumps, pool sweeps, leaks, etc.) within two weeks, we will perform a “Beyond Normal Maintenance” billed at a flat rate of $35.


Indemnities

By signing up for service, you acknowledge that Aqua Vista Pro Pool Service LLC will not be held responsible for damage otherwise pre-existent or caused by weather, landscape services, construction, organic or metallic stains, etching, corrosion, underground leaks, or deterioration due to equipment breakdowns or malfunctions. Should damage be caused by one of our technicians due to negligence regarding the standard and duty of care, this contract requires Aqua Vista Pro Pool Service LLC to investigate the claims and report them to their insurance provider.


Billing

Invoices are sent out on the 1st of each month for the current month of service; payment is due by the 15th. If repairs were made, they will be billed for on the following month's invoice. Invoices paid past the 30th/ 31st will result in a late fee of $25. Unpaid invoices past 30 days will result in termination of service. We understand extenuating circumstances befall us all and may make it difficult to make payment by a specific date; if this occurs and you wish to waive late fees and termination of this contract, a written notice will be required.


Acceptance

By signing up for service, you indicate your approval of the terms of service outlined above and enter into a month-to-month service contract with Aqua Vista Pro Pool Service LLC. You or Aqua Vista Pro Pool Service LLC may cancel this contract by providing written notice via email seven days before the next billing cycle.
